The Centers for Medicare & Medicaid Services (CMS) is extending the public comment period for the RFI: Recommended Measure Set for Medicaid-Funded Home and Community-Based Services to November 18. The RFI seeks feedback on potential benefits of and challenges that could result from a nationally available set of recommended quality measures for voluntary use by states, managed care organizations, and other entities engaged in the administration and/or delivery of Medicaid-funded home and community-based services. HCAOA’s Data and Research Committee will be submitting comments on the proposal with the Medicaid Partnership for Home-Based Care.

Connecticut: Chapter Continues Advocacy for Medicaid Rate Increase The HCAOA Connecticut State Chapter continues to advocate for an increase in Medicaid reimbursement rates for home care providers. In a major disappointment, the Department of Social Services recently posted on its website a modest increase in reimbursement and then withdrew it, purportedly to await the results of its provider rate cost survey and study. Joe Markley of Companions & Homemakers has led the advocacy efforts of the Chapter’s DSS Medicaid committee, forming a coalition of organizations supporting an increase, drafting a letter to the Governor in support and lobbying state officials. Click here to register Last week, CMS released new data showing a 46% increase in the number of Medicare Advantage plans offering supplemental benefits such as home care – from 500 plans in 2020 to 730 in 2021. The most offered supplemental benefits include in-home supportive services, support for caregivers, home-based palliative care, adult day and therapeutic massage.
A coalition including HCAOA, the International Franchising Association, National Retail Federation and others, have sent a letter to Congressional Democrats asking them to join in voting for a discharge petition to release $130 million in funds that was left unused when the Paycheck Protection Program expired in August.
ShareLast week, the U.S. Department of Labor (DOL) issued a long-anticipated proposed rule in the Federal Register addressing when a worker is an employee or independent contractor under the Fair Labor Standards Act (FLSA).
In the proposed rule, the DOL retains its long-standing “economic reality” test. This multi-factor test helps determine whether a worker is in business for themselves or is economically dependent on an employer for work. Earlier this week, President Trump announced that HHS is releasing 150 million rapid-response COVID-19 tests. Of the 150 million, 10 million will be distributed to home, health, and hospice care agencies, which includes home care agencies.
Governors and public health officials across the country have implemented stringent measures to help contain the spread of COVID-19, such as stay at home orders, mask orders, and business screening requirements. You can find lists of these orders, compiled by Littler Mendelson, in the following links: Earlier this week, House Democrats released a slimmed-down $2.2 trillion legislative package. A possible vote could occur later this week on this new package. However, Senate Republicans are on record not wanting to spend $1 trillion for relief efforts, so it is unclear whether a deal can be reached.

Earlier this week the U.S. Department of Labor’s Wage and Hour Division (WHD) posted a notice of proposed rulemaking to offer clarity in determining whether a worker is an employee under the Fair Labor Standards Act (FLSA) or an independent contractor.
