According to a recent article in Home Health Care News, the payer source most likely to dictate the future of home-based care providers is Medicare Advantage (MA), even though plans’ in-home supplemental benefit offerings will take a dip for the first time in 2024. In-home support services (IHSS), which offer an MA entry point for home care providers, grew rapidly from 2020-2023, with the amount of plans offering them growing from 283 to 1,308. In 2024, though, only 867 plans will be offering IHSS, according to the research and advisory firm ATI Advisory.

![]() The Illinois Department of Labor (IDOL) introduced proposed regulations for the Illinois Paid Leave for All Workers Act, scheduled to take effect on January 1, 2024. This Act mandates nearly all covered Illinois employers to offer up to 40 hours of annual paid leave for any purpose. All Illinois members are invited to a webinar TOMORROW, November 16 to learn more about this. Hinshaw labor and employment attorney Aimee E. Delaney will discuss how the Illinois Paid Leave for All Workers Act will impact home care. This event is free for members and registration is required. Joyce Grayson, a home health nurse for Elara Caring, was murdered on October 28, 2023, in the home of a patient where she was providing services. Ms. Grayson was reported missing by a family member to the local police department. The family member was also able to track her last location to the home of a patient she was scheduled to visit at 8:00 a.m. on the day of her death. The patient resided at a halfway house for convicted sex offenders. Police have not yet formally identified a suspect in Ms. Grayson’s death.
![]() On June 23, 2023, the Illinois Department of Public Health (IDPH) proposed a First Notice of new, proposed regulatory rules to update the Home Health, Home Services, and Home Nursing Agency Code to include administrative requirements for home health and home services agencies with more than one location. Additionally, the rulemaking also sought changes to the requirements for client service plans, including required elements of the plan. ![]() The Administration for Community Living (ACL) has secured $3 million in funding over four years for the 2022 National Strategy to Support Family Caregivers. ACL will grant a cooperative agreement to undertake a national project aiming to advance programs authorized by the Older Americans Act, specifically the National Family Caregiver Support Program and the Native American Caregiver Support Program. The project will focus on providing technical assistance and capacity building activities for aging, tribal, and kinship support networks to strengthen financial and workplace security for family caregivers. This initiative aligns with President Biden's Executive Order on Increasing Access to High-Quality Care and Supporting Caregivers, signed on April 18, 2023, which enhances caregiving support. ![]() The National Labor Relations Board (NLRB) has introduced a significant change in the definition of "joint employer" under the National Labor Relations Act. The new rule, effective from October 27, 2023, expands the criteria for two or more companies to be considered joint employers of the same employees. Under this rule, joint employment is established when these companies "share or codetermine those matters governing employees' essential terms and conditions of employment," including factors such as wages, benefits, work scheduling, hiring, discipline, and more. A notable change is the consideration of both direct evidence of control and evidence of reserved and indirect control over these essential employment terms. ![]() In Washington state, the new Nursing Assistant skills test went into effect on October 1, 2023. The purpose of the change is to increase access to skills testing following graduation. Graduates will be expected to pass the skills test before registering for the written test, which saves steps and time in the testing and certification process. By 2024, most nursing assistant training programs will provide skills testing routinely after graduation. One of the biggest changes is graduates will no longer register for the skills test on Credentia365 but will continue to use the platform to obtain their Candidate ID number. |
