The Massachusetts Supreme Judicial Court (SJC) recently handed down a key ruling that the three-prong test for independent contractors applies to the relationships between a franchisor and its franchisee, where the franchisor must also comply with the Federal Trade Commission’s (FTC) Franchise Rule.
The SJC held that the independent contractor statue applies to the franchisor-franchisee relationship and is not in conflict with the franchisor’s disclosure obligations set forth in the FTC Franchise Rule. The SCJ determined a franchisee providing services to a franchisor under the terms of a franchise agreement may, in fact, be classified as an “employee” of the franchisor under state wage-and-hour law. To ensure a smooth transition to the electronic visit verification (EVV) system for in-home services provided by the three waivers operated by the South Carolina Department of Disabilities and Special Needs (SCDDSN), the state DHHS is delaying the EVV launch and go live timelines, initially scheduled for April 4 and 5.

A recent update from the CDC recommends that certain immunocompromised individuals and people over 50 years who received an initial booster dose at least four months ago are eligible for another booster to increase their protection against COVID-19. People with Medicare can get a second Pfizer-BioNTech or Moderna COVID-19 vaccine at no cost with no applicable copayment, coinsurance or deductible. CMS is covering the cost for qualified individuals in an effort to ensure maximum access to COVID-19 vaccinations. Medicaid beneficiaries can also get COVID-19 vaccines, including first boosters, at no cost.
The CDC also recommends that adults who received a primary vaccine and booster dose of Johnson & Johnson’s Janssen COVID-19 vaccine at least four months ago can receive a second booster dose of a Pfizer-BioNTech or Moderna COVID-19 vaccine. More information regarding the CDC COVID-19 Vaccination Program Provider Requirements and how the COVID-19 vaccine is provided through that program at no cost to recipients is available at https://www.cdc.gov/vaccines/covid-19/vaccination-provider-support.html and through the CMS COVID-19 Provider Toolkit. Two St. Louis television stations chose HCAOA Member and Veterans Home Care founder Bonnie Laiderman as one of four local honorees from over 180 nominations for its Remarkable Women award, an initiative to celebrate local inspiring leaders. In 2003, Laiderman started Veterans Home Care, a family home care business to help veterans or surviving spouses of veterans find home care with no out-of-pocket expenses by helping them apply for VA aid to pay for in-home assistance. The organization has helped more than 20,000 veterans and their spouses. Laiderman also launched SmartCompanion Care LLC, which provides smart home technology for seniors through Alexa. The company installs and sets up the service and customizes it to provide 24-7 security. She plans to add calls to the service, adding “It’s terribly sad that the elderly people are alone, and days can go by, and they never talk to anybody.” Read more about Laiderman here.
